The problem is further aggravated due to disproportional growth ratio of Internet and cyber laws. Though a beginning has been made by the enactment of I.T. Act and amendments made to Indian Penal Code, problems associated with cyber crimes continue to persist. Jurisdiction is the highly debatable issue as to the maintainability of any suits, which has been filed. Today with the growing arms of cyber space the territorial boundaries seem to vanish. Thus the concept of territorial jurisdiction as envisaged under S.16 of Cr.P.C. and S.2.of the I.P.C. will have to give way to alternative method of dispute resolution. Loss of evidence is a very common & expected problem as all the data are routinely destroyed. Further, collection of data outside the territorial extent also paralyses the system of crime investigation. Cyber Army: There is also an imperative need to build a high technology crime & investigation infrastructure, with highly technical staff at the other end. A law regulating the cyber-space, which India has done. Though S.75 provides for extra-territorial operations of this law, but they could be meaningful only when backed with provision recognizing orders and warrants for Information issued by competent authorities outside their jurisdiction and measure for cooperation for exchange of material and evidence of computer crimes between law enforcement agencies. Cyber savvy judges are the need of the day. Judiciary plays a vital role in shaping the enactment according to the order of the day. One such case, which needs appreciation, is the P.I.L. (Public Interest Litigation), which the Kerala High Court has accepted through an email. 'Perfect' is a relative term. Nothing in this world is perfect. The persons who legislate the laws and by-laws also are not perfect. The laws therefore enacted by them cannot be perfect. The cyber law has emerged from the womb of globalization. उपयुक्त माहिती आहे.फसवणारा भारताच्या बाहेर आणि युजर भारतात अश्यावेळी आतरराष्ट्रिय मदत घ्यावी लागणार्.मदत पटकन पाहिजे तर दुसर्याला मदत पटकन केलीही पाहिजे.आन्तर्राश्ट्रिय पातळीवर भारताची प्रतिमा ह्या बाबतित चान्गली नाही.'पैसे खावुन वेळ्काढुपणा करणारे' ही प्रतिमा भारतिय पोलिस अधिकार्याना बदलावी लागेल.समजा एखादा राजकारणी पुत्र पकडला गेला तर तो नक्कि वर्षभर तरी जेलची हवा खाईल एवढा विश्वास लोकाना वाटला तरच ह्या सगळ्या कायद्याना अर्थ आहे. शिवाय भारताला आपली आय्.टी. मुलभुत सेवा खुपच भक्कम करावी लागेल. बर्याच सरकारी वेब साईट्स धुम धडाक्यात चालु होतातं. नन्तर काही कालावधि नन्तर त्या तश्याच पडिक असतात.

राजे, माहिती चांगली आहे. परंतू याचा काही फायदा होईल का याची शंका वाटते. असे कायदे अमेरिकेत्/युरोपात आधीपासूनच आहेत पण संगणक हॅक करणे/विषाणू पसरवणे/पोर्नोग्राफी हे काही कमी झालं नाही. कारण हे जे लोक करतात (हॅकर्स) ते एक पायरी वरच असतात. तसेच कायद्यातल्या खाचाखोचा (लूपहोल्स) वापरून बर्‍याचदा यातून सुटता येते. या बाबतीत पुरावा जमवण्याबाबतीत पोलीसही किती कार्यक्षम ठरतील हा चर्चेचा आणि वादाचा विषय होऊ शकेल. एलेक्ट्रॉनिक फोरेन्सीक या शास्त्राबद्दल भारतात कितपत माहिती आहे? ४ वर्षाची संगणक शास्त्राची पदवी घेतलेल्या सुद्धा ९०% लोकांना या बाबत काहीही माहीती नसते. सायबर क्राईम घडल्यानंतर ई-फोरेन्सीकनेच या गोष्टी सिद्ध करता येतात ज्या साठी आधी पोलीसदल त्या दृष्टीने सक्षम करणे फार आवश्यक आहे. नुसता कायदा केला पण गुन्हा घडल्यानंतर तो पुराव्याने शाबीत करण्यासाठी पुरावा कुठला आणि कसा गोळा करायचा याचे ज्ञान नसले तर कायदा करून न करून सारखाचं. आणि भारतात तर राजकिय वरदहस्त असला तर एखाद्याचा खून पण सहज पचवता येतो. साक्षीदार फितवले/फोडले जातात, पुरावा नष्ट केला जातो. यातून खरोखर किती केसेस मध्ये खरोखर न्याय मिळतो. कधी कुठल्याही राजकिय पुढार्‍याला कोर्टात गुन्हा शाबीत होऊन शिक्षा झाल्याचे आणि ती त्याने भोगल्याचे ऐकीवात तरी आहे का? त्यामुळे हे सगळे कागदावरच छान, छान दिसणार आहे. - नाटक्या
